Terms and Conditions (T&C) – CamperFix App

1. Scope and Contracting Party

These Terms and Conditions (hereinafter “T&C”) govern the use of the mobile application “CamperFix” (hereinafter the “App”) and all related services.

2. Description of the App and Services

CamperFix is a mobile app for motorhome and caravan travelers and offers the following features:

  • Search and display of workshops, camping supply stores, gas supply, water supply, car washes, and laundromats
  • Community features for exchange with other travelers
  • Rating features
  • Premium features with extended functionality

3. Registration and User Account

3.1 Registration

Registration is required to use certain features of the App. During registration, users must provide truthful and complete information.

3.2 User Account

Users are required to keep their login credentials confidential and to inform the provider without undue delay if there is reason to believe that third parties have obtained knowledge of such credentials.

4. Subscription Models: Premium and RoadService

4.1 General

Depending on availability, CamperFix offers different paid subscription models, in particular:

  • Premium Subscription
  • RoadService Subscription

The scope of features, pricing, terms, and any trial periods are displayed in the App and/or in the respective app store.

4.2 Premium Subscription

The Premium Subscription includes enhanced features for App usage.
The specific features are based on the current feature description shown in the App.
Premium may include Community Help and AI Help. These features do not entitle users to successful help from other users or error-free AI outputs (see Section 7.6).

4.3 RoadService Subscription

The RoadService Subscription includes all features of the Premium Subscription plus additional RoadService-specific functionality.
It is intended for users who wish to offer their own services while on the road.

4.3.1 Scope of Services

RoadService users may in particular maintain their own provider profile, present services, and be discoverable in the App, insofar as such functions are made available in the App.

4.3.2 Responsibility of RoadService Users

RoadService users are solely responsible for their own offers. This includes in particular:

  • accuracy and completeness of the information provided
  • legal permissibility of the services offered
  • compliance with commercial, tax, consumer-protection, and other applicable legal obligations
  • proper performance of services toward customers

CamperFix is not a party to contracts concluded between RoadService users and their customers.

4.4 Trial Periods

CamperFix may offer time-limited free trial periods for Premium and/or RoadService.
Duration, start, availability, and conditions are displayed in the App and/or in the respective app store.

4.5 Pricing and Billing

Current prices are displayed in the App and in the respective app stores (Apple App Store, Google Play Store).
Billing is processed via the respective app store providers; technically, RevenueCat may be used for this purpose.

5. Automatic Renewal and Cancellation

5.1 Automatic Renewal

All paid subscriptions (in particular Premium and RoadService) renew automatically for the selected billing period (e.g., monthly or yearly) unless cancelled in time.

5.2 Cancellation

  • Subscriptions can be cancelled at any time via the subscription management of the respective app store.
  • To prevent renewal, cancellation generally must be completed no later than 24 hours before the end of the current billing period (in accordance with app store policies).

5.3 Cancellation Process

Apple iOS:

  1. Settings → [Your Name] → Subscriptions
  2. Select CamperFix
  3. Tap “Cancel Subscription”

Google Android:

  1. Open Google Play Store
  2. Profile/Menu → Payments & subscriptions → Subscriptions
  3. Select CamperFix
  4. Tap “Cancel”

5.4 Effectiveness of Cancellation

  • After successful cancellation, the subscription remains active until the end of the already paid period.
  • Premium features remain available until expiry.
  • Afterwards, the account is reset to free account status.
  • Refunds are subject to the policies of the respective app store.

6. Right of Withdrawal

6.1 Withdrawal Notice

Consumers generally have a statutory right of withdrawal.

6.2 Expiry of the Right of Withdrawal for Digital Content

Where legally permitted, the right of withdrawal for digital services may expire prematurely if the user expressly agrees that performance begins before the withdrawal period expires and acknowledges the loss of the right of withdrawal.

6.3 Processing

Withdrawal, cancellation, and refund handling for in-app purchases are additionally governed by the rules of the respective app store.

7. Usage Rules and Obligations

7.1 Permitted Use

The App may be used only for private, non-commercial purposes unless explicitly agreed otherwise.

7.2 Prohibited Use

The following actions are prohibited:

  • transmission of harmful software or code
  • infringement of copyrights or other third-party rights
  • harassment, discrimination, or threats against other users
  • publication of false, misleading, or defamatory content
  • circumvention of technical protection measures

7.3 Community Guidelines

When using community features, users must interact respectfully and comply with applicable laws.

7.4 Special Obligations for RoadService Users

RoadService users may only offer services if legally authorized to do so. In particular, they must:

  • keep all offer-related information truthful, up to date, and complete
  • comply with required commercial, regulatory, tax, and professional obligations
  • offer only services they can competently and actually perform
  • present pricing, terms, and scope of services transparently
  • comply with applicable consumer information obligations

RoadService users act under their own responsibility and at their own risk when creating offers and providing services.

7.5 Contractual Relationships Between RoadService Users and Customers

Contracts regarding RoadService services are concluded exclusively between the respective RoadService user and the requesting customer.
CamperFix is neither a representative nor an intermediary with performance liability, and is not a contractual party to such contracts.

7.6 Community Help and AI Help

7.6.1 Nature of the service

CamperFix provides technical features enabling users to contact each other (“Community Help”) and receive AI-assisted guidance (“AI Help”). CamperFix does not provide breakdown assistance, emergency services, workshop services, or binding technical diagnoses. Community Help and AI Help are not a substitute for emergency number 112, qualified professionals, roadside assistance, or medical care.

7.6.2 Availability and Premium

Community Help and AI Help are Premium features available only to eligible users. A Premium subscription does not entitle users to help from other users, responses, helper availability, or accuracy of AI outputs.

7.6.3 Community Help (help marker)

Users of Community Help may make location, problem description, and category visible to other logged-in users as a help marker. The marker is time-limited (usually up to 24 hours, maximum up to 72 hours if extended) and is automatically ended or removed thereafter.

Users must:

  • set help markers only for genuine technical help needs,
  • provide truthful and factual information,
  • in acute danger (especially gas odor, fire, injuries) immediately contact 112 or a professional and not rely solely on Community Help,
  • end the marker when help is no longer needed.

7.6.4 Role of helpers

Users responding to a help marker act privately and at their own responsibility. They are not agents, representatives, or vicarious agents of CamperFix. CamperFix does not verify helpers for qualification, availability, or reliability.

7.6.5 AI Help

AI Help provides automated, non-binding guidance based on user input and, where applicable, stored vehicle data. AI outputs may be incomplete or incorrect and do not replace professional on-site assessment. Users must not use AI guidance as the sole basis for work on safety-critical systems (especially gas, high voltage, brakes, steering).

7.6.6 Prohibited use

In particular, the following is prohibited:

  • false, misleading, or abusive help markers,
  • using Community Help or AI Help as a substitute for emergency or medical services,
  • encouraging dangerous actions,
  • harassment, threats, or discrimination in the help context,
  • circumventing technical safeguards (e.g. rate limits, bans).

7.6.7 Moderation

CamperFix may review, hide, delete help markers and related content, or temporarily or permanently suspend accounts for violations. User reports may be taken into account.

9. Availability and Technical Requirements

9.1 Availability

The provider strives to ensure high availability of the App but cannot guarantee uninterrupted availability.

9.2 Technical Requirements

Using the App requires a compatible device, up-to-date operating system versions, and an internet connection.

10. Liability and Warranty

10.1 Liability

The provider has unlimited liability in cases of intent and gross negligence, as well as in cases of injury to life, body, or health.
In cases of slight negligence involving the breach of essential contractual obligations, liability is limited to the typical and foreseeable damage.
In all other cases, liability is excluded to the extent permitted by law.

10.2 Warranty

Statutory warranty rights apply.

10.3 Liability for Content and Services of RoadService Users

CamperFix assumes no responsibility for the accuracy, completeness, quality, availability, or legality of content and services provided by RoadService users.
Responsibility lies solely with the respective RoadService user.

10.4 No Liability for Contract Performance Between Users

CamperFix is not liable for:

  • the conclusion, performance, or non-performance of contracts between RoadService users and customers
  • service disruptions, defects, damages, or consequential damages arising from such contracts
  • breaches of duty by RoadService users toward customers or third parties

unless mandatory legal provisions provide otherwise.

10.5 Indemnification

RoadService users shall indemnify CamperFix against third-party claims arising from their offered services, content, or legal violations, including reasonable legal defense costs, insofar as the RoadService user is responsible for the violation.

10.6 Liability for Community Help and AI Help

CamperFix provides no warranty regarding the accuracy, completeness, timeliness, suitability, or success of:

  • information and content from users in Community Help,
  • advice, commitments, or actions of other users (helpers),
  • outputs of AI Help.

Responsibility for decisions and actions based on Community Help or AI Help lies solely with the respective user.

CamperFix is not liable for the formation, performance, or failure of help between users, for damages from incorrect AI outputs, or for consequential damages from use of Community Help or AI Help, to the extent permitted by law.

11. Amendments to the T&C

The provider may amend these T&C with effect for the future where there is a valid reason (e.g., legal changes, technical changes, extension of features). Users will be informed of changes in due time. Any legally required consents will be obtained expressly.

12. Termination of the User Agreement

12.1 Ordinary Termination

The user agreement for the free account may be terminated by either party at any time.

12.2 Extraordinary Termination

The right to extraordinary termination for good cause remains unaffected.

13. Dispute Resolution and Applicable Law

13.1 Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers, this choice of law applies only to the extent that it does not deprive them of mandatory consumer protection provisions of the state in which they have their habitual residence.

13.2 Place of Jurisdiction

For consumers, statutory places of jurisdiction apply.
For merchants, legal entities under public law, or special funds under public law, the provider’s registered seat shall be the place of jurisdiction to the extent legally permissible.

13.3 Online Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform:

14. Severability Clause

Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.
